郑州市出台土地网拍细则 中场熔断价格受限违约重罚   记者 陈骏   核心提示|历经数次“剧透”与“网传”,所有关心郑州土地市场走向人士所期待的“网拍细则”昨日傍晚终于正式出炉。傍晚近六点,在郑州市政府官方网站上,一个由郑州市人民政府办公厅下发,名为《郑州市国有建设用地(住宅)使用权网上挂牌交易限价竞买暂行办法》(以下简称《暂行办法》)的文件虽深藏网站细节栏目“闺中”,还是被不少人给“扒了出来”。   “‘面粉’价格有了‘天花板’,‘严’字当头,‘面包’再乱涨价就说不过去了。”细读新规则后,一位地产人士用“面粉”、“面包”借喻土地与房价的关系道明了自己对未来郑州房价走势的判断。与此同时,来自网拍土地“出让人”郑州市国土资源局(以下简称市国土局)的消息称,此前郑州集中推出的6000亩住宅用地将于本月迎来密集挂牌期,并预计于12月上中旬迎来集中成交期。“细则再细也要看实际操作,具体怎么办,还需要看现实中的操作情况。”地产从业人士苏先生说。   拍地分为“上、下半场”   通读这一文件的大河报记者发现,在这份《暂行办法》中明确写道,国有建设用地(住宅)(以下简称住宅用地)使用权出让过程原则上分为两个环节进行。第一环节为使用郑州市国土资源网上交易系统(以下简称网拍系统)进行网上竞价,达到限价时转为第二环节;第二环节为现场一次竞价或网上一次竞价。第二环节中,郑东新区、郑州经济开发区管辖范围内采取竞综合房价方式确定土地竞得人;金水区、管城回族区、二七区、中原区、惠济区、郑州高新区(以下简称市内五区及高新区)管辖范围内采取竞地价方式确定土地竞得人。   那么,第一、第二环节究竟怎么过渡?“拍地细则”也明确规定,任一竞买人在网拍系统中报(竞)价首次达到住宅用地出让起始价150%时,网拍系统报价中止。竞买人也将从第一环节的“上半场”进入“下半场”展开进一步的角逐。参照目前流行的说法,文件也将这一“150%”的临界点命名为了“熔断点”。   自中秋节前“剑指地王”的“郑九条”子夜出台后,无数地产人士都期盼着后续更为详尽规则的来临。昨晚,“拍地细则”的出台让郑州的住宅用地网拍有了下一步更为详尽的具体规则。正式将日后郑州土地市场的“网拍机制”划分为了“上、下半场”,而“中场哨响”则为“熔断点”的触发。   给价格戴上“紧箍”   对于此前郑州土地市场网拍从未有过的“下半场”,暂行办法也有着较为详细的“竞赛规则”。   打个比方说,如竞拍标的宗地的代码为“A”,如在网拍时A地块的最终报价没有超过熔断价的,由网拍系统自行确定土地竞得人及成交地价(如A在郑东、经开范围内,则需同时执行该宗地综合房价最高限价规定)。   如A宗地的竞拍一旦进入“下半场”,对于A地块的角逐将转为现场或者网络一次性竞价。   在这一竞价中,竞买人需在五分钟内完成报价。对于郑东新区和经开区范围内的宗地,选手报出的是“综合房价”,谁低谁中标,土地中标价格即“熔断价”本身。同时,这一“竞得综合房价”也将被写入土地出让合同补充条款,竞得人在该宗地上所建楼盘不得高于这一房价进行销售。   对于郑州市内其他区域的宗地而言,最终的胜果取决于“下半场”所报出的“地价”。“竞赛规则”规定,各“选手”将在公证机构的公证下报出竞买价,此后竞拍组织者将按照所有有效报价计算平均值。哪位“选手”所报地价最接近于平均值的,则为该宗地的最终竞得人,所报出的价格,也是该宗地最终的地块成交价。对于这个价格,《暂行办法》也给出了“天花板”:报价在不低于熔断地价的基础上,不得高于出让起始价的200%。   “罚单”将设“黑名单”   如前文业内人士对《暂行办法》“严字当头”的评价,除前文所述对地价戴上的“紧箍”外,这一文件还专门用一章的内容对“违约责任”进行了明确。   其中,对于竞买人有下列情形之一的,即被视为违约:   (一)熔断人必须参加现场竞价而不参加现场竞价的;   (二)郑东新区、郑州经济开发区范围内熔断人现场必须报综合房价且报价符合报价规则而现场不报综合房价,或者现场报价不符合报价规则的;   (三)竞得人逾期未按《挂牌须知》的约定持竞得证明等相关资料报出让人进行后置审核,或者所提供资料不符合要求未通过审核,从而造成宗地竞买无效后果的。   而对于“违约”,《暂行办法》所开出的“罚单”也可谓严厉,包含了竞买保证金不予退还;由市国土局将其纳入黑名单,即日起不得参加郑州市市域内土地公开出让交易活动;以及地块另行组织出让的价格低于本次挂牌成交价的,由违约人支付差额赔偿金等严厉措施。   “对比之前,拍地成了技术活儿。”纵观《暂行办法》所列条款,一位供职于国内某一线地产公司的资深人士对大河报记者说,对于拿地决策流程较为复杂的一线房企而言这些要求确实有着一些影响,“拍地程序更为复杂,不过难度倒是没有什么特别的变化。”他说。   与此同时,也有不少业内人士表示,《暂行办法》的规定还有待“实践体验”。“你比如说‘定地价,竞房价’的规则,有的房子带装修,有的不带装修,这你怎么去评价?装修规格也不尽相同,你怎么去衡量?还有能不能捆绑车位呢?”他表示,这所有的疑问,也有待拍地时,宗地“前置条件”的具体约定。   6000亩地是“试验田”   “如果说‘郑九条’的出台是‘示意选手走上跑道’,那今天就是给‘选手’传达规则,并举起了‘发令枪’。‘6000亩地’将一见分晓。”伴随着《暂行条例》的正式颁布,此前由郑州市国土局发布,即将走上网拍流程的“6000亩住宅用地”无疑将成为新规则的“试验田”。郑州市国土资源局相关负责人向大河报记者透露:“规则已出,11月将密集挂牌,下月上旬、中旬将成为密集成交期。”   对于这“6000亩地”,此前已被无数业内人士视为“郑州未来房价走势”的重要参考。那么,当“6000亩”与《暂行办法》相叠加,又会对未来的郑州房价有何影响?   “前有集中供地,后有‘熔断出台’,‘面粉’价有了‘天花板’,‘面包’再乱涨价就说不过去了。”细读新规则后,一位地产人士用“面粉”、“面包”借喻土地与房价的关系道明了自己对未来郑州房价走势的判断。但与此同时,另一位地产人士则表示,“行政手段强压势必带来房价下降,但未来会不会迎来‘报复性上涨’,谁都不好说。”   在这种猜测中,或许郑州房价将进入一个“平台期”,对于后市是涨是跌,或许“观望”将成为不少人的共同选择。相关的主题文章:
